RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY, FILM/PHOTO RELEASE, AND PARENTAL CONSENT AGREEMENT

In consideration of being permitted to participate in the activities and events of Art Du Déplacement Chicago LLC, I, for myself, and for my personal representatives, assigns, heirs, and next of kin:

1. Acknowledge, agree, and represent that I understand the nature of Art Du Déplacement Chicago LLC activities, that these are physical in nature, and that I am qualified, in good health, and in the proper physical condition to participate in such activities. I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the activity.

2. Acknowledge and fully understand that (a) activities involve risks and dangers of serious bodily injury, including permanent disability, paralysis, and death; (b) these risks may be caused by my own actions or inactions, the actions or inactions of others participating in the activity, the conditions in which the activity takes place, or the negligence of the “Releasees” named below; (c) there may be other risk and social and economic losses either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL RISK AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of my participation in Art Du Déplacement Chicago LLC activities and events.

3. HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE Art Du Déplacement Chicago LLC, its administrators, directors, agents, officers, members, volunteers, and employees, other participants, sponsors, advertisers, and, if applicable, owner and lessors of the premises on which the activity takes place (each considered one of the “Releasees” herein) from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the “Releasees” or otherwise, including negligent rescue operations and I further agree that if, despite this Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement, I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save, and hold harmless each of the Releasees from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as a result of such a claim.

4. HEREBY GIVE, CONSENT, AND FOREVER GRANT TO Art Du Déplacement Chicago LLC, its representatives, licensees, marketers, and any other related parties or publishers of its promotional materials and their successors and assigns, the right to use, publish and copyright my picture, portrait or likeness, in photo, video and film format, in whole or part, including alterations, modifications, derivations, and composite thereof, in CDs, films, advertising and similar such promotions and renditions throughout the world. This right shall include the right to combine my likeness with others and to alter my likeness by digital or other means.

I also hereby release Art Du Déplacement Chicago LLC and such other parties from any obligation to make any payment hereunder or from any other liability incurred in connection with the use of any the materials described above. I acknowledge my full and complete satisfaction with the terms of this Release. Minors who participate in Art Du Déplacement Chicago LLC’ activities and events are required to execute the Addendum Release by Minor append hereto, with additional, corresponding signature of parent and/or legal guardian.

By the use of the Hosting Facility, the undersigned expressly agrees that the Hosting Facility shall not be liable for any damages arising from personal injuries sustained by the undersigned or his/her guest(s) in, on or about the premises of the said facilities and further agrees that the facility shall not be liable for any loss or theft of personal property.

The undersigned assumes full responsibility for any injuries, damages or losses which may occur to the undersigned or guest, in or about the premises of said facilities and does hereby fully and forever release and discharge the facility, its owners, employees, partners, and agents from any and all claims, demands, damages, rights of action, or causes action, present or future, whether the same be known or unknown, anticipated or unanticipated, resulting from or arising out of the undersigned or his/her guests use or intended use of the said facilities and facilities equipment thereof. The undersigned warrants, represents and agrees that the undersigned is in good physical condition and that he or she has no disability, impairment or ailment preventing him or her from engaging in active or passive exercise that will be detrimental or inimical to his or her health, safety, comfort or physical condition if he or she does so engage or participate. It is recommended that everyone consult their physician before beginning any exercise program.

By accepting this agreement, I affirm that I have read this agreement in its entirety, fully understand its terms, and have signed it freely and without inducement of assurance of any nature, and intend it to be a complete and unconditional release of liability to the greatest extent allowed by the law and agree that if any portion of this agreement is held to be invalid, the balance, notwithstanding, shall continue in full force and effect. Illinois law shall apply to this agreement.
